Points totting up?

If you commit an endorseable offence within three years of the imposition of points and the new offence will bring you up to 12 points, then the Court must disqualify you from driving unless there are mitigating circumstances such that they might exercise their discretion not to do so.

The minimum period of disqualification is 6 months, unless there has been a previous disqualification which the Court must take into account within the 3 years prior to the offence, in which case the minimum is 12 months, or 24 months if there are 2 such previous disqualifications.

For hardship to be taken into account it must be exceptional.

If you are looking at 12 points or more, contact us for advice or representation.

Remember that the same reason for the Court exercising their discretion in your favour is not available twice in a three year period.
