Driving without insurance offences

Using a motorbike or motor vehicle on a road or in another public place without valid insurance (or letting someone else do so) is an offence.

If you let someone else ride your motorbike, you are under a positive duty to check that insurance is in place.

‘Using’ a vehicle does not necessarily mean driving or riding. ‘Using’ may refer to parking during repair work or similar.

If an insurer has provided cover but a policy is yet to be issued, no offence is committed.

No NIP (Notice of Intended Prosecution) is required for offences of driving without insurance.

You face affine up to £5,000, 6-8 penalty points or a discretionary disqualification from driving for the offence of driving without insurance.

Prosecution must be brought within 6 months from the date on which the offence was brought to the police’s attention or 3 years from the offence (the shortest applies).

Using a vehicle without an MOT certificate

All vehicles registered for use on the road for 3 years or more require an MOT certificate and MOT testing and renewal is required annually.

It is an offence to use or allow your motorbike to be used without a relevant test certificate.

If it can be proved that the motorbike was used on the road by the prosecution, you are obliged to provide a valid MOT test certificate.

Fines of up to £1,000 apply for using a vehicle without an MOT certificate. If one is obtained immediately this may help reduce your sentence since the vehicle has been proved to be safe.

It is a defence to be taking the vehicle to or from an MOT test Which has been pre-booked.
